1. Acceptance of Terms

By accessing or using Bridgeflow ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including free trial users, paying subscribers, and any other parties who access the platform.

2. Description of Service

Bridgeflow provides AI-powered messaging automation tools that help businesses manage customer conversations across channels including WhatsApp, Instagram DMs, Facebook Messenger, SMS, and web chat. We offer automated replies, lead qualification, appointment booking, and human handoff capabilities.

Features available to you depend on the subscription plan selected. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with reasonable notice.

3. Account Registration

You must create an account to use Bridgeflow. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at bridgeflow.work@gmail.com if you suspect any unauthorised use of your account.

4. Free Trial

We offer a 14-day free trial on selected plans. The free trial begins on the date of account creation. No credit card is required to start a free trial unless otherwise stated.

At the end of the free trial period, your account will be downgraded to a limited free tier or you will be prompted to select a paid plan. We reserve the right to modify or end the free trial offer at any time.

5. Payment and Billing

Paid plans are billed monthly or annually as selected at the time of purchase. All fees are stated in USD unless otherwise indicated. Prices are exclusive of applicable taxes unless stated otherwise.

Subscriptions renew automatically unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

WhatsApp Business API usage fees (charged by Meta) are separate from Bridgeflow subscription fees and are billed directly according to Meta's pricing. Bridgeflow is not responsible for these charges.

6. Acceptable Use

You agree not to use Bridgeflow to send spam, unsolicited messages, or content that violates applicable laws or the terms of service of any connected platform (including WhatsApp Business API policies).

You may not use the Service for any unlawful purpose, to harass or harm others, to distribute malicious software, or to attempt to gain unauthorised access to our systems or any third-party systems.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy without prior notice.

7. Intellectual Property

All intellectual property rights in the Bridgeflow platform, including software, design, content, and trademarks, are owned by or licensed to Bridgeflow. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes.

You retain ownership of all content and data you input into the platform. By using the Service, you grant Bridgeflow a limited licence to process and transmit your content solely to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

9. Availability and Uptime

We aim to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. Scheduled maintenance windows will be communicated in advance where possible.

Bridgeflow shall not be liable for any losses arising from downtime, interruption, or technical failures beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bridgeflow shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Termination

You may terminate your account at any time by contacting us or via account settings. We may suspend or terminate your access to the Service if you breach these Terms or if we determine, in our sole discretion, that continued access poses a risk to the platform or other users.

Upon termination, your right to access the Service ceases immediately. We may delete your data in accordance with our data retention policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice within the platform. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.
